Acceptance of These Terms
By creating an account or using BananaBird, you agree to these Terms of Service. If you do not agree, please do not use the service.
BananaBird is a sole proprietorship owned and operated by Kevin Fox in Ontario, Canada. In these Terms, “BananaBird,” “we,” “us,” and “our” refer to Kevin Fox carrying on business as BananaBird.
Your use of BananaBird is also governed by our Privacy Policy and Acceptable Use Policy, which describe how we collect and protect your information and the standards for using the service responsibly.
The Service
BananaBird is a personal finance management application that allows users to organize, track, and analyze their financial information.
Features may change over time as the application evolves.
Subscriptions and Billing
Some features of BananaBird require a paid subscription. Current pricing, trial terms, and billing details are presented before you subscribe.
Payments are processed by Stripe. By providing a payment method, you authorize Stripe to charge the applicable subscription fees and agree to Stripe’s terms and privacy practices.
Paid subscriptions renew automatically at the applicable billing interval until cancelled. You may cancel through the billing settings in the application. Unless otherwise stated, cancellation takes effect at the end of the current billing period, and you may continue using paid features until that time.
Subscription fees are generally non-refundable, including for partially used billing periods, except where required by applicable law or where we choose to provide a refund at our discretion.
We may change subscription pricing in the future. Any pricing change will be communicated before it applies to a subsequent billing period, and you may cancel your subscription before the new price takes effect.
You are responsible for keeping your billing information current. Failed or overdue payments may result in restricted access, expiration of your subscription, or termination of your account.
Accounts
You are responsible for maintaining the security of your account and for all activity that occurs under your account.
You must provide accurate information when creating your account and keep your contact information reasonably up to date.
Your Data
You retain ownership of the information you enter into BananaBird.
You are responsible for ensuring that you have the right to store any information you upload or enter into the application.
We do not claim ownership of any data you place within the service.
No Financial Advice
BananaBird is provided as a personal finance tracking and organizational tool.
The application does not provide financial, investment, accounting, tax, or legal advice. Any reports, calculations, charts, forecasts, or other information generated by BananaBird are provided for informational purposes only.
Service Availability
We strive to keep BananaBird available and reliable but cannot guarantee uninterrupted access.
The service may be temporarily unavailable due to maintenance, upgrades, security events, failures or interruptions involving third-party service providers, or other circumstances beyond our reasonable control.
Limitation of Liability
BananaBird is provided on an "as is" and "as available" basis.
To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, consequential, or special damages, including loss of data, financial losses, or business interruption resulting from your use of the service.
Suspension and Termination
You may stop using BananaBird or request deletion of your account at any time.
Cancelling a paid subscription does not necessarily delete your account. Your access may continue until the end of the current billing period, after which paid features may become unavailable.
We may restrict, suspend, or terminate access where payments remain overdue, where you violate these Terms of Service or the Acceptable Use Policy, or where suspension is reasonably necessary to protect the service, its users, or comply with applicable law.
Governing Law
These Terms of Service are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.
Changes to These Terms
We may update these Terms of Service from time to time. When significant changes are made, we will update the effective date and, where appropriate, provide notice within the application.
